All India Film and TV Entertainment Artists Welfare Association (AIFAWA)

AIFAWA is incorporated under Section 8 of the Companies Act, 2013 and operates exclusively for charitable, educational, cultural, welfare, skill development, awareness, artist welfare, community development, and public benefit purposes.

AIFAWA is a welfare-focused organization dedicated to supporting artists, creative professionals, entertainment industry workers, and other eligible beneficiaries through charitable, educational, welfare, awareness, skill development, and community support initiatives.

This Donation Policy explains how donations are accepted, managed, utilized, and governed by AIFAWA.

By making a donation to AIFAWA, you acknowledge that you have read, understood, and agreed to this Donation Policy.

1. PURPOSE OF DONATIONS

Donations received by AIFAWA are utilized solely for the advancement of its charitable, welfare, educational, cultural, awareness, skill development, community development, and public benefit objectives.

Donations may be used for activities including:

• Artist welfare initiatives
• Educational support programs
• Skill development programs
• Awareness campaigns
• Welfare assistance programs
• Emergency relief initiatives
• Counselling and guidance programs
• Community outreach activities
• Administrative and operational requirements necessary for carrying out the objects of the Association
• Any other lawful activity consistent with the objectives of AIFAWA

2. VOLUNTARY CONTRIBUTIONS

All donations made to AIFAWA are voluntary contributions.

Donors are under no obligation to make donations and AIFAWA does not guarantee any direct or indirect benefit in exchange for a donation.

3. NO ENTITLEMENT OR BENEFIT

A donation to AIFAWA does not create:

• Membership rights
• Voting rights
• Employment opportunities
• Project assignments
• Artist recognition
• Welfare eligibility
• Financial benefits
• Preferential treatment
• Sponsorship opportunities
• Business opportunities
• Any contractual or legal entitlement

All programs and assistance remain subject to applicable policies and eligibility requirements.

4. UTILIZATION OF FUNDS

AIFAWA shall utilize donations in accordance with:

• Applicable laws
• Its Memorandum of Association (MOA)
• Internal policies
• Organizational priorities
• Availability of resources
• Executive Committee decisions

The Association reserves the right to allocate, reallocate, prioritize, defer, modify, or discontinue any initiative based on organizational requirements and beneficiary needs.

5. DONOR INFORMATION

Donors may be required to provide information including:

• Name
• Address
• Mobile Number
• Email Address
• PAN Number (where applicable)
• Donation Amount
• Other information required by law or policy

Such information shall be handled in accordance with the AIFAWA Privacy Policy.

6. TAX BENEFITS

Where applicable and subject to the validity of registrations and approvals available to AIFAWA under applicable law, eligible donors may claim tax benefits.

Availability of tax benefits shall remain subject to:

• Applicable laws
• Government regulations
• Valid registrations and approvals
• Individual donor eligibility

Donors are advised to consult their tax advisors regarding individual tax implications.

7. OFFICIAL DONATION CHANNELS

Donations should be made only through official channels authorized by AIFAWA.

These may include:

• Official website
• Official payment gateway
• Official bank account
• Official donation links
• Other authorized channels notified by AIFAWA

AIFAWA shall not be responsible for payments made through unauthorized persons, unofficial accounts, personal QR codes, personal wallets, or unapproved payment methods.

8. FUNDRAISING RESTRICTIONS

No member, volunteer, coordinator, GENZ Member, Artist Member, representative, supporter, or third party may collect donations, contributions, sponsorships, welfare funds, or monetary payments in the name of AIFAWA without prior written authorization.

Unauthorized fundraising may result in disciplinary action, termination, legal action, or reporting to authorities.

9. REFUND OF DONATIONS

All donations made to AIFAWA are voluntary and shall ordinarily remain non-refundable, non-transferable, and non-adjustable.

Exceptions may be considered only in cases of:

• Duplicate payment
• Proven technical payment error
• Multiple deductions for the same transaction

Any decision regarding such cases shall be at the sole discretion of AIFAWA.

10. TRANSPARENCY AND ACCOUNTABILITY

AIFAWA is committed to responsible utilization of funds and maintaining appropriate records as required by law.

The Association may maintain records, accounts, receipts, and supporting documentation relating to donations in accordance with applicable legal and regulatory requirements.

11. NO GUARANTEE OF ASSISTANCE

Donations received by AIFAWA do not guarantee that any particular individual, member, artist, beneficiary, project, event, program, or initiative will receive assistance.

Allocation of resources shall remain subject to organizational assessment and approval processes.

12. NO OWNERSHIP OR CONTROL RIGHTS

Donations do not provide donors with ownership rights, management rights, control rights, decision-making authority, governance rights, representation rights, or any interest in the assets, funds, activities, programs, operations, or administration of AIFAWA.

13. LIMITATION OF LIABILITY

AIFAWA shall not be liable for any direct, indirect, incidental, consequential, financial, business, or reputational loss arising from donations, utilization of funds, donor expectations, program decisions, or organizational priorities.

14. POLICY CHANGES

AIFAWA reserves the right to amend, revise, modify, suspend, replace, or update this Donation Policy at any time without prior notice.

The latest version published on the website shall prevail.

15. GOVERNING LAW

This Policy shall be governed by the laws of India.

16. JURISDICTION

Any dispute arising from or relating to donations made to AIFAWA shall be subject to the exclusive jurisdiction of the competent courts at Nagpur, Maharashtra, India.

IMPORTANT NOTICE

By making a donation to AIFAWA, the donor acknowledges that donations are voluntary contributions made in support of the charitable and welfare objectives of the Association and do not create any right, claim, entitlement, preference, guaranteed assistance, financial benefit, employment opportunity, special privilege, ownership interest, management right, or control over the affairs of AIFAWA.
